1. Agreement to These Terms
These Terms and Conditions of Use govern your access to and use of Loanster’s website, loan-request marketplace service, and related features. By accessing or using the service, you acknowledge that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.
Please read these Terms carefully. They contain important information about your rights and obligations, including electronic communications, disclaimers, limitations of liability, and dispute resolution.
2. Loan Marketplace Service
Loanster operates an advertising referral and marketplace service that may connect consumers with participating lenders, lending partners, and other financial-service providers. To use the service, you may be asked to submit contact, identity, employment, income, housing, and banking information.
Loanster is not a lender, loan broker, or agent for any lender. Loanster does not make loans, make credit decisions, determine underwriting criteria, or guarantee that any provider will respond to your request.
3. Provider Offers and Credit Decisions
Participating providers independently evaluate request information under their own criteria. Loanster does not guarantee approval, an offer, a particular loan amount, rate, fee, term, product, or funding time, and does not represent that any offered terms are the best available.
A provider may verify your information, obtain a consumer report, or conduct a hard or soft credit inquiry as permitted by your authorization and applicable law. A hard inquiry may affect your credit score.
If you are connected or redirected to a provider, your interaction is governed by that provider’s terms, privacy policy, disclosures, and loan agreement. Loanster is not a party to any agreement between you and a provider.
4. Communications and Electronic Disclosures
By submitting a request and providing contact information, you consent, where permitted by law and as described in applicable disclosures, to receive communications from Loanster and participating providers by email, telephone, text message, automated technology, direct mail, or other means.
You may be required to receive notices, disclosures, records, and agreements electronically and to use an electronic signature. Electronic signatures and records may have the same legal effect as paper documents and handwritten signatures. Carrier message and data rates may apply.
5. Your Information and Responsibilities
You represent that information you submit is accurate, current, complete, and belongs to you. You agree not to impersonate another person, submit fraudulent information, interfere with the service, introduce harmful code, attempt unauthorized access, or use the service for an unlawful purpose.
Loanster may restrict, suspend, or terminate access when it reasonably believes these Terms, applicable law, or the rights of Loanster or another party have been violated.
6. Service Availability and Changes
Loanster may change, suspend, or discontinue any part of the service at any time. We do not guarantee uninterrupted availability or that the service will be free from errors, delays, or technical problems. Loanster is not responsible for delays or errors caused by inaccurate information, third parties, networks, devices, or circumstances beyond its reasonable control.
7. Third-Party Sites and Services
The service may link to websites and services operated by participating providers or other third parties. These links are provided for convenience and do not constitute an endorsement. Loanster does not control and is not responsible for third-party content, products, services, security, availability, or privacy practices.
8. Disclaimers
THE WEBSITE AND SERVICE ARE PROVIDED “AS IS” AND “AS AVAILABLE,” TO THE FULLEST EXTENT PERMITTED BY LAW. LOANSTER DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AVAILABILITY, AND RESULTS.
YOUR USE OF THE SERVICE IS AT YOUR OWN RISK. LOANSTER DOES NOT ENDORSE OR RECOMMEND A PARTICULAR PROVIDER OR FINANCIAL PRODUCT AND IS NOT RESPONSIBLE FOR A PROVIDER’S REVIEW, CREDIT DECISION, OFFER, AGREEMENT, OR PERFORMANCE.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, LOANSTER AND ITS AFFILIATES, SERVICE PROVIDERS, MARKETING PARTNERS, PARTICIPATING PROVIDERS, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE SERVICE, ANY DELAY OR INABILITY TO USE IT, OR ANY PRODUCT OR SERVICE OBTAINED THROUGH IT.
Some jurisdictions do not allow certain exclusions or limitations. In those jurisdictions, liability will be limited to the greatest extent permitted by law.
10. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Loanster and its affiliates, service providers, officers, directors, employees, and agents from claims, liabilities, losses, damages, and reasonable expenses arising from your misuse of the service, violation of these Terms, or infringement of another party’s rights.
11. Dispute Resolution and Arbitration
PLEASE READ THIS SECTION CAREFULLY BECAUSE IT MAY AFFECT YOUR RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION. To the extent enforceable under applicable law, disputes arising from these Terms or the service may be resolved through final and binding individual arbitration rather than in court, except that eligible individual claims may be brought in small-claims court.
Claims must be brought on an individual basis and not as a plaintiff or class member in a class, consolidated, or representative proceeding, unless applicable law requires otherwise. Before commencing arbitration, the parties should attempt in good faith to resolve the dispute through written notice describing the claim and requested relief.
The applicable arbitration administrator, rules, notice process, governing law, costs, opt-out rights, and legally required exceptions will be identified in Loanster’s Arbitration Notice and incorporated into these Terms.
12. Privacy
Our Privacy Policy describes how Loanster collects, uses, discloses, and protects personal information and is incorporated into these Terms. You should also review the privacy policy of any participating provider with whom you interact.
13. General Terms
These Terms and incorporated policies constitute the agreement between you and Loanster concerning the service. If a provision is invalid or unenforceable, it will be enforced to the greatest extent permitted and the remaining provisions will remain effective.
A failure to enforce a provision is not a waiver. Loanster may update these Terms by posting a revised version with a new effective date. Your continued use after an update constitutes acceptance to the extent permitted by law.
